A Michigan court ruled in favor of a class of Domino’s delivery drivers, finding they are owed the full Michigan minimum wage rather than the tipped minimum wage. This decision was reached after it was determined that the defendant, STA Management, failed to obtain signed declarations from each employee before each pay day.
Michigan Minimum Wage
The minimum wage in Michigan is $13.73 and every worker is entitled to it regardless of tips earned. Unless employers can prove they meet at least one of the exceptions, they must pay the full minimum wage. An employer that is eligible to use a tip credit must receive a signed statement from each employee at the end of each pay period in acknowledgment of the tip credit. Employers found to be in violation of the tip credit rules are required to pay the full minimum wage.
