A crude oil hauler filed a lawsuit against her employer, Ace Gathering Inc., in February 2022, alleging that the company intentionally misclassified her and other crude haulers as salaried to avoid paying them overtime. In May 2022, attorney Colby Qualls, now associated with Forester Haynie, entered an appearance in the case, and he, along with three other attorneys, are now representing four crude haulers who are part of the lawsuit. Plaintiffs are currently before the Fifth Circuit Court of Appeals requesting that the Fifth Circuit revisit its decisions regarding the scope of an overtime exemption as it applies to employees whose transportation is entirely intrastate.
The case is called Escobedo, et al. v. Ace Gathering, Inc., and was originally filed in the United States District Court Southern District of Texas.
