Suit Filed in Texas Alleges Personal Injury

A lawsuit has been filed against Walmart Inc. and Walmart Fulfillment Services, LLC in Texas, alleging that the plaintiff developed carpal tunnel syndrome and was not properly compensated. The defendant is being pursued a potential sum exceeding $75,000.

Initially, the plaintiff was hired as a “packer,” whose role consisted of packaging merchandise. This repetitive motion of the plaintiff’s hands created pain in her left hand, so she was sent home from work after reporting it to her supervisor. The following day, the plaintiff requested leave due to her sustained painful injury. However, it wasn’t until 3 months later that the management service and defendant responded to her request. She was placed on the Family and Medical Leave Act (FMLA) for another 3 months. After the leave ended, the plaintiff could not return to work, and the defendant refused to extend her leave.

A few months down the line, the plaintiff underwent various gruesome surgeries. She had to pay out of pocket for these surgeries because she had not received any compensation from Walmart. The plaintiff allegedly received the injuries while working for the defendant, so they must be held liable for their lack of proper assessment of this situation. It isn’t uncommon for these situations to occur in workers’ lives. However, the company should be held accountable for their lack of proper safety and care implemented into their employees’ lives.

The lawsuit is called Kellerhals v. Walmart Inc et al, pending in the Northern District of Texas.
