Does your company treat you like an employee but call you an “independent contractor”? This is a pervasive problem, and it’s against the law! It’s an easy way for a company to shift tax and wage burdens onto workers, because for an independent contractor, the company does not withhold taxes like it would with an employee.

“The general rule is that an individual is an independent contractor if the payer has the right to control or direct only the result of the work and not what will be done and how it will be done.”

If youre unsure about whether or not it’s “worth it” to stand up for your rights as a contractor check out what happened to Microsoft after they misclassified hundreds of their employees in the early 2000s.

Even if you agreed to be a “contractor,” you have rights and may have a possible claim if your company is not meeting the correct standards. It is the company’s job to get the law right.
