The U.S. Federal court in Arizona where more than 3,000 Bard IVC Filter lawsuits have been consolidated indicated recently that the first bellwether trial would be tried in two phases. The first phase will determine liability and compensatory damages, followed by a second phase to determine whether punitive damages should be awarded.

Since August 2015, all Bard IVC Filter lawsuits filed throughout the US Federal court system have been centralized before U.S. District Judge David G. Campbell in the District of Arizona.

IVC filters are small, spider-like devices that are implanted into the inferior vena cava to prevent blood clots from traveling to the lungs and causing a pulmonary embolism. However, design problems associated with several different retrievable IVC Filters products have been linked to reports of severe injuries, including embedded filters, punctured organs and vessels, filter fracture, and even death.
